RULES CONCERNING APPEARANCE AND COEXISTENCE
URBANISATION BENAMARA DOS HERMANAS

Any closed extension that requires a major building license by the Estepona Town Hall will not be authorized by our committee, according to the letter that we sent to all owners on date 20/03/2019.

As detailed in the letter from the Town hall Licenses will only be granted for minor refurbishment, maintenance and conservation works.

In any case, any minor work must be approved by our committee after the verification of said license.

It is not permitted to implement any type of works on Sundays, public holidays, or during the high season of Easter, the months of July and August and Christmas.

Communicate to your neighbours the dates of any work is very convenient for not to coincide the holidays

In continuation, we set out these basic rules to ensure the original appearance is kept

1. MAIN DOORS

  • Must be of wood and dark oak in colour, the same as the original construction.

  • Of aluminium in imitation of wood, dark oak in colour, with details in accordance with the appearance of the doors within the Community.

2. GATES

Must be of black iron, without plastic material fabric behind. If more privacy is required, black metal mesh can be installed behind.

3. WINDOWS AND DOORS

  • Windows must always have the glazing bars in accordance with the originals.

  • They can be of dark oak coloured wood, as the originals, but also of aluminium or PVC in dark oak colour or white.

4. WINDOW GRILLS
• These shall be of the same style and colour as the originals (black).

5. PAINTWORK OF THE PROPERTIES.

  • The buildings, adjoined dwellings and villas shall be painted in white, with mouldings in white or albero (ref. albero: in Pinturas Andalucía colour Ocre Emulcril 10). Always maintaining the original color.

  • The villas which from the time of their construction were painted another colour, shall retain said colour, or be painted white like the rest of the properties in the Urbanisation.

  • For the good maintenance of the apartment buildings, same shall be painted at least every 5 years, with each owner paying their proportional part. Owners are not permitted to paint the exterior of their apartments on their own account.

6. WALLS AROUND PROPERTIES

These must always be white in colour and can have the following installed on top to increase privacy:

  • Iron railings, black in colour

  • Good quality briar screening

  • White latticework

7. GARAGE DOORS

These shall be in dark oak coloured wood, or of aluminium also in dark oak colour. It is not permitted to install chains in the parking spaces, or signs.

8. LAMP POSTS AND WALL LIGHTS
These shall be of Andalusian style, following the line of those in the Urbanisation. 9. PORCHES AND

9. TERRACES

It is not permitted to enclose porches and terraces, since this would be considered as an extension of the property.

Permitted improvements in porches must be as follows:

  • Masonry columns must be finished in white render or finished with rustic brickwork or dark oak wood.

  • Roofing: this can be finished in roof tiles of the original style and the interior boarding in wood colour, with the beams always in dark oak colour. The boarding can be white.

10. CHANNELLING OF WATER ON PORCH ROOFS

Roofs of porches in the upper apartments must be equipped with guttering such that water does not run down the building’s façade or on to the apartment underneath.

Roofs of porches in the upper apartments must be equipped with guttering such that rainwater is discharged into the terrace of same. Said guttering must be the same colour as the wall to which it is attached and not be visible from the street.

11. AWNINGS

These must be of fabric, with yellow and white stripes (an example is available in the Community office).

In the case of owners with awnings of other colours, when they need renewing, this must be done in the correct colours, yellow and white stripes.

12. BLINDS

These can be of the roller type, Andalusian style, in common with the construction and beige in colour. We remind you that roller blinds are very useful, since they help keep the dwelling cool in summer.

The blinds can also be automatic, white or brown, dark oak.

13. AIR-CONDITIONING

Authorisation in writing from the Committee is required prior to commencing installation.

Air-conditioning units must be installed low down, virtually sitting on the ground and concealed as far as possible. The tubing must be built in to the wall and not visible. This applies to upper as well as lower apartments and includes the following types of properties: apartments, adjoined dwellings and villas.

Noise produced by the units must not disturb neighbours and any water generated must be directed into the property in question.

14. PARABOLIC AERIALS

Request must be made to the Urbanisation’s Committee in regard as to where to locate same and both the aerial and the cabling must be concealed as far as possible.

15. SOLAR PANELS

• Authorisation in writing from the Committee is required prior to commencing installation.
• Should it prove necessary to install a water tank, this must be situated inside the dwelling. Under no circumstances can it be on the roof or in a place visible by other owners.

16. FIBRE OPTIC CABLES

Authorisation in writing from the Committee is required prior to commencing installation. Fibre optic cables must be built-in and not visible.

17. USE OF THE GREEN ZONE FOR OWNERS’ EVENTS

In order to respect the peace and quiet of owners, it is not permitted to hold events in the green zones, and children´s area or play golf in the gardens or green zones. For playing of football there is a football pitch in the children’s playground.

18. PETS

Dog owners must have their dogs on a lead at all times, both in the streets as well as in garden areas and, of course, they must remove their excrement.

In order not to disturb the neighbours, owners must ensure their dogs do not bark, either during the day or at night.

It is not permitted to feed cats in the streets.

19. TOWELS

It is not permitted to hang towels or washing on the window grills, awnings or walls of terraces. This is to prevent it being visible from the street. All towels and washing must be hung below wall height

20. WORKS CONTAINERS

  • Authorisation in writing from the Committee is required prior to commencing installation. The Administration shall inform as to location of the container.

  • The office shall be informed as to the period during which the containers will be installed.

  • The containers must be emptied regularly and located in places which do not constitute a danger to

    vehicles. They must be provided with warning lights at night.

  • Once the container has been removed, the owner is responsible for the roadway being left in perfect condition.

21. SWIMMING POOL

  • The rules for use of the swimming pool are on display at same.

  • We remind you that children must always be in the care of an adult.

  • The sun-beds are for communal use. They are not for exclusive use and therefore cannot be reserved.

  • It is obligatory to replace the sun beds back in their original position after use

  • In order to access the swimming pool, a special key is required, which is available in the office.

22. SILENCE

Kindly respect the “siesta” hours, from 15.00 to 16.30, both at the swimming pool and throughout the Urbanisation.

It is not permitted to play games and/or make noise after 12 at night and in August not after 12.30. Do not play music outside, so as not to disturb neighbours.

23. SECURITY

For your security, close up your house when you are absent.
